TERMS OF USE & END USER LICENSE AGREEMENT (EULA)

This Terms of Use & End User License Agreement ("Agreement") governs your use of SkeletonFocus ("Licensed Application" or "App") developed and published by Firat GULEC ("Application Provider", "Licensor"), distributed through Apple’s App Store.

SkeletonFocus is a focus timer with animated skeleton companions, break scenes, a daily timeline, and a collectible roster. This Agreement is intended to comply with Apple App Store requirements and applicable laws, including Türkiye KVKK and, where relevant, GDPR.

1. GENERAL & THIRD-PARTY SERVICES

By using SkeletonFocus, you expressly acknowledge and agree that:

• Your license is subject to your prior acceptance of this Agreement and Apple’s Standard EULA.
• You acknowledge that this Agreement is between you and the Licensor only, and not with Apple. Apple is not responsible for the Licensed Application or its content.
• The App may use Apple services required to distribute, update, or process purchases for the Licensed Application.

2. FOCUS, REST & WELLBEING DISCLAIMER

SkeletonFocus helps you start timed focus blocks, watch a companion walk while the clock runs, rest in Breaktime, and review sessions on Timeline.

• Timers, rest scenes, session titles, and statistics are for personal organization and entertainment only.
• The App is not a medical device, therapy tool, or treatment for attention, sleep, anxiety, or any health condition.
• You remain responsible for how you use your time, including breaks, device use, and any work or study decisions.
• The Licensor does not guarantee productivity, habit change, or any specific outcome from using the App.

3. SCOPE OF LICENSE

Licensor grants you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded device you control, as permitted by Apple’s Usage Rules.

You may not:

• Distribute, rent, lease, lend, sell, sublicense, or transfer the App;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, except where permitted by law;
• Modify, copy, or create derivative works of the App, except where permitted by law;
• Use the App for any unlawful or prohibited purpose, including entering content you do not have the right to store.

4. SUBSCRIPTIONS, COLLECTIONS & PAYMENTS

If paid features, additional skeletons, or other unlocks are offered, all payments are processed exclusively through Apple In-App Purchase using your Apple ID. The Application Provider does not collect or store credit card information.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

4.1 Auto-Renewable Subscriptions

• If a subscription is offered, it automatically renews unless cancelled at least 24 hours before the end of the current period.
• You may manage or cancel subscriptions via: Settings > Apple ID > Subscriptions on your device.
• Deleting the App does not automatically cancel your subscription.

4.2 Refunds

The Application Provider cannot issue refunds directly. All refund requests must be submitted to Apple and are subject to Apple’s refund policies.

5. YOUR CONTENT

You retain ownership of display names, custom timeline titles, and other text you add to SkeletonFocus. You are responsible for the accuracy of that information and for not entering content that is unlawful or that you do not have the right to store.

Companion models, animations, scenes, trademarks, and other App assets remain the property of the Licensor and its licensors. Unlocking a skeleton grants you a license to use that companion inside the App, not ownership of the underlying artwork.

6. DATA PRIVACY & CONSENT

To provide its core functionality, the App stores Focus Data you create and the display name you choose. You agree that the Licensor may collect and process this data as described in our Privacy Policy.

Data Deletion: You may delete stored data through the options within the App settings where available, or by contacting the Licensor.

7. NO WARRANTY

The Licensed Application is provided "AS IS". To the maximum extent permitted by law, Licensor disclaims all warranties regarding accuracy, reliability, completeness of session records, or uninterrupted availability of the App.

8. LIMITATION OF LIABILITY

Licensor shall not be liable for any indirect or consequential damages, including loss of data or lost work time, arising from the use or inability to use the App. How you spend your focus blocks remains your responsibility.

9. GOVERNING LAW

This Agreement is governed by the laws of Türkiye, without prejudice to mandatory consumer protection laws in your country of residence (for example, GDPR requirements for EU users).

10. THIRD-PARTY BENEFICIARY

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
